Purpose

This Candidate Privacy Notice (“Notice”) for Canada and the U.S. applies to Oppy and its relevant affiliates (David Oppenheimer and Company I, L.L.C.; David Oppenheimer and Associates General Partnership; David Oppenheimer Transport, Inc., Servicios Agricolas Openheimer Chile Limitada, “us,” “we,” or “our”). This Notice describes how Oppy collects, uses, stores and shares the personal information of job candidates who apply for positions within Oppy in the United States or Canada; who we contact for or who express interest in employment with us; who attend a recruitment event; or who undergo an interview or assessment with us (“Candidate(s)” or “you”).

This Notice also describes the rights that Candidates may have in relation to the personal data that we process about them. As used in this Notice, “personal data” means any information that relates to, identifies, or reasonably could be used to identify an individual, directly or indirectly.

 

What information do we collect, and why?

The categories of personal and sensitive personal information about Candidates that we may collect and process include, but are not limited to, the following (some or all of these categories may apply to you):

Information Necessary to Confirm Ability to Work for Oppy Includes information we may be legally required or permitted by local law to collect as part of the application process, such as immigration information, citizenship, proof of vaccination, or visa information.
Public Information May include social media profiles or interactions (where permitted) and information shared online which is freely visible to the public.
Characteristics of Protected Classifications under Provincial, State or Federal Law May include race or ethnic origin (optional), gender identity (optional), sexual orientation (optional), nationality (optional), ethnicity (optional), medical conditions (optional), military or veteran status (optional), and disability (optional) or information about certain health conditions (where relevant and in accordance with the requirements of applicable laws).
Professional or Employment Information May include resume information such as previous employment information, date of hire, job title, department and business unit, salary, work location, work status (e.g., full time/part time), information pertaining to work preferences, skills, and abilities, education (academic degrees, certifications and transcripts) and references.
Other Information May include any information you may provide in connection with your candidacy for employment, such as compensation history, travel and expense-related information, etc.
Sensitive Personal Data Includes government identifiers, race or ethnic origin (optional), gender identity (optional), sexual orientation (optional), ethnicity (optional), medical conditions (optional), disability (optional), visa information, immigration information, and proof of vaccination.

 

How do we process and/or use the information we collect about you?

Oppy may process your personal information for business purposes that include, but are not limited to:

  • administering the application and recruitment process (e.g., setting up an electronic job applicant file; managing your application; conducting assessments; organizing interviews, including arranging and reimbursing for travel; providing accommodations; processing interview feedback; onboarding; conducting background checks and screening);
  • communicating with you about other Oppy job opportunities;
  • meeting recordkeeping and internal and external reporting responsibilities;
  • complying with legal obligations;
  • pursuing or defending against legal actions or claims; and
  • protecting the rights, property, life, health, security, and/or safety of us or any third party.

Most of the personal information we process is obtained from you when you submit your application, but we also obtain personal information about you in the course of the application and recruitment process (for example, during interviews or via job assessments). Additionally, we may collect certain types of personal information about you from third parties, including, for example, from recruitment agencies.

If you are offered and you accept a role at Oppy, the Candidate personal data collected during the recruiting process will become part of your employee file and will be governed by the Oppy Employee Privacy Notice, a copy of which will be provided to you when you are onboarded as an employee.

 

How do we share your information?

Your personal information may be shared within Oppy and with our affiliates where it is lawful to do so and for legitimate business purposes.

We use third parties to provide services in connection with the application and recruitment process. In providing such services, your personal information may be shared with and processed by those third-party service providers on behalf of Oppy for the purposes of providing services to Oppy.

In other circumstances, we may share your personal information with third parties that may use and process the personal information for their own purposes, including, but not limited to:

  • Service providers (eg. data storage and platform providers)
  • Insurance companies
  • Employee benefits providers
  • Law enforcement, government agencies, and other recipients for legal, security, and safety purposes
  • In connection with a corporate transaction, including if we sell, acquire, or merge all or some of our assets
  • Professional advisors, such as lawyers, accountants, and auditors
  • Affiliates and subsidiaries within the Oppenheimer Group, which includes parent and ultimate holding companies, affiliates, subsidiaries, business units and other companies that we acquire in the future after they are made part of David Oppenheimer and Company.
  • To which you have consented to the disclosure

 

How long do we retain your information?

Your personal data will be stored in accordance with applicable laws and kept as long as needed to carry out the purposes described in this Notice (or as otherwise required by applicable law). If you are successful with your job application, your personal data will be kept in accordance with Oppy’s Employee Privacy Notice. If you are unsuccessful with your job application, your personal data will be kept for the duration of the application process, plus a reasonable period of time after confirmation that your application was unsuccessful to allow us to record the reasons for our decision in relation to your application (including so that we can exercise, establish, or defend any legal claims). Where permissible, we may also retain your personal data for a reasonable period to consider you for other suitable openings within Oppy in the future.

Personal information may also be shared with another organization in the event of a merger or change of ownership of all or part of Oppy.

 

Candidates Located Outside the United States

If you are located outside of the United States, please be aware that personal information that is collected from or about job candidates may be transferred to, and processed in, the United States. The data privacy laws in the United States may be different from those of the country in which you are located. Your providing us with any information constitutes your consent to the transfer to, and processing of, your personal information in the United States as set forth in this Privacy Notice. We will take reasonable care to ensure that your personal information is treated fairly and lawfully.

 

Supplemental Information for California Candidates

Pursuant to the California Consumer Privacy Act (CCPA), this section applies to certain personal data collected about Candidates that are California residents and supplements the rest of our Notice above.

This section does not apply to the following personal data:

  • Information about Candidates who are not California residents;
  • Information about Oppy employees. Such information is subject to a separate Employee Privacy Notice that we make available to Oppy employees; or
  • Information that Oppy processes about you if you interact with Oppy as a user of our products or services.

Disclosing California Candidate Personal Data: the above-mentioned table details the categories of Candidates’ personal information and to whom it may be disclosed to for business purposes. Oppy has not sold or shared personal information of Candidates in the past 12 months. Oppy only uses Sensitive Personal Information, as defined by California law, consistent with the exceptions to the right to limit Sensitive Personal Information.

Your California Data Protection Rights: California Candidates may have certain rights, subject to legal limitations, concerning the collection, use, and disclosure of their personal data:

  • Right to Know. You have the right to request information about the categories of personal data we have collected about you, the categories of sources from which we collected the personal data, the purposes for collecting the personal data, and to whom we have disclosed personal data and why (“Categories Report”). You may also request the specific pieces of personal data we have collected about you (“Specific Pieces Report”).
  • Right to Delete. You have the right to request that we delete personal data that we have collected from you.
  • Right to Correct. You have the right to request that we correct inaccurate personal data that we maintain about you.

California Candidates may request to exercise the above rights by submitting a request to [email protected]. We will not discriminate against you for exercising your privacy rights. We will respond to all requests within 45 days, unless we need more time, in which case we will notify you and may take up to 90 days total to respond to your request.

Verification: In order to process requests, we will need to obtain information to locate you in our records or verify your identity, depending on the nature of the request. In most cases, we will request information about you, which may include your name, email address, or other information. If you submit a Right to Know “Specific Pieces Report,” we may also request a signed declaration, under penalty of perjury, that you are who you say you are. We may request alternative information under certain circumstances and/or use third parties to help verify your identity.

Authorized Agents: Authorized agents may request to exercise rights on behalf of California Candidates, but we reserve the right to also verify the Candidate’s identity directly as described above. Authorized agents must contact us by submitting a request through our webform and indicate that they are submitting the request as an authorized agent. Authorized agents must provide evidence of their identity and documentation evidencing proof of the authorized agent’s legal authority to act on the behalf of the individual California Candidate.

 

How do we protect your information?

We maintain physical, electronic, and procedural safeguards to protect the confidentiality and security of your personal information, including security measures to protect against unlawful or unauthorized processing of personal information, and against the accidental loss of, or damage to, personal information.

 

Your Rights under Applicable Data Privacy Laws

Depending on the laws of the country/state/province where you reside, you may have certain rights regarding your personal information, such as the right to access or correct your personal information.
